The Australian Human Rights Commission has decided that lesbians are not allowed to gather without the presence of men

The decision

In 2003, A transgender person challenged the lesbians

  • Lost on a technicality

  • Some lesbians didn’t support them

The explanation given for this in the Explanatory Memorandum for the Amending Act was that ‘sex is not a binary concept’. Importantly, for present purposes, the provisions of the SDA also suggest that a person’s ‘sex’ can be changed.
